Privacy policy
1. Scope
This policy describes how Janover Capital LLC ("Janover Capital," "we," "us") collects, uses, shares and protects information in connection with cre.capital (CRE Capital, the "Site"), which Janover Capital operates. It applies to this Site only; other Janover sites and third-party websites linked from the Site have their own policies. By using the Site, you agree to this policy and to our Terms of use.
2. Information we collect
The debt request form (/financing-request/) collects: property type, state, city (optional), loan purpose, senior loan amount, purchase price or value, annual net operating income (optional), the lender type you lean toward, when you need to close, whether you want a senior loan, a mezzanine loan or both, the mezzanine amount (optional), whether the deal also needs preferred or JV equity, your name, your role, your email, your phone (optional) and any message you write.
The contact form (/contact/) collects your name, email, phone (optional) and message.
Both forms also send hidden fields: the page you sent it from, the campaign tags (UTM parameters) in the link that first brought you to the Site and the referring page, if any, and the exact consent sentence shown next to the button. A hidden spam trap field is meant to stay empty.
The stack builder runs in your browser. The numbers you type into it are not sent to us unless you go on to send the debt request form, which fills in some of them for you to review.
Automatically. Our hosting provider, Cloudflare, processes standard technical data such as your IP address, browser type, the pages you request and the referring page, to deliver the Site and protect it from abuse. Pages that show the 10-year Treasury yield ask our own server for the latest published figure; that request carries no personal information.
From other sources. If you ask us to work on your financing, we may receive information about you or the transaction from public records, lenders and transaction parties such as appraisers or title companies.
3. How we use information
To evaluate, size and arrange the financing you ask about; to reply to you and communicate about your request and our services, including by phone, text and email as described in section 5; to operate, secure and improve the Site; to comply with law and legal process; to enforce our Terms; and to detect and prevent fraud and abuse. We may use aggregated or de-identified information that does not identify you for any lawful purpose.
4. How we share information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. Requests sent through the Site go to Janover Capital. We share them as follows:
- Lenders and transaction parties, only at your direction or with your consent, so they can evaluate or close your financing (for example lenders, appraisers, title companies and counsel).
- Service providers: Cloudflare, which hosts the Site and the database where form submissions are stored, and our email provider, which delivers your request to our team.
- Affiliates of Janover Capital, for the purposes in this policy.
- Professional advisors such as lawyers and accountants, as reasonably needed.
- Legal and safety: when we believe disclosure is required by law or legal process, or needed to enforce our agreements or protect rights, property or safety.
- Business transfers: in a merger, acquisition, financing, reorganization or sale of all or part of our business.
5. Communications and your choices
If you give us contact details, we may contact you by phone, text and email about your request and our services, as described in the Terms. Consent to marketing communications is not a condition of any service. Reply STOP to opt out of texts, use the unsubscribe link in marketing emails, or contact us at (561) 559-4111 or hello@cre.capital to update your preferences. We may still send non-promotional messages about an active request or transaction.
6. Cookies and browser storage
The Site sets no cookies and runs no analytics. It uses your browser's session storage, which is cleared when you close the tab, to remember the campaign tags and referring page from your first visit and the stack builder numbers, so the debt request form can fill them in. Nothing in session storage reaches us unless you send a form. The Site does not respond to "Do Not Track" signals; where the law requires, we honor opt-out preference signals such as Global Privacy Control.
7. Data retention
We keep information as long as reasonably necessary for the purposes in this policy, including transaction records and legal, tax, accounting and regulatory requirements. Form submissions are stored in our Cloudflare database and deleted when no longer needed for your request or our records. When information is no longer needed, we take reasonable steps to delete or de-identify it.
8. Security
We use commercially reasonable safeguards. No method of transmission or storage is completely secure. Please don't send sensitive personal information, such as Social Security numbers or account credentials, through the Site's forms; if a transaction needs sensitive documents, we will arrange a proper channel.
9. Your privacy rights
Depending on where you live, you may have the right to know, access, correct or delete the personal information we hold about you, get a portable copy, or opt out of certain processing. Much of what we handle relates to commercial transactions and may be exempt from some state privacy laws; we honor valid requests as the law requires. Contact hello@cre.capital or (561) 559-4111 with your name, contact details and the request. We may need to verify your identity, and we won't discriminate against you for exercising your rights. Authorized agents may submit requests with proof of authorization.
10. Children
The Site is a commercial finance site for adults. It is not directed to anyone under 18, and we do not knowingly collect their information. If you believe a minor has sent us information, contact us and we will delete it.
11. Users outside the United States
The Site is operated from and intended for the United States. If you use it from elsewhere, your information will be transferred to and processed in the United States.
12. Third-party links
The Site links to sources it cites, including Altus Group, the U.S. Securities and Exchange Commission (EDGAR), the Electronic Code of Federal Regulations, Fannie Mae, Freddie Mac, CBRE and Cornell's Legal Information Institute. This policy doesn't apply to those sites; read their policies directly.
13. Changes to this policy
We may update this policy. The revised version will be posted here with a new effective date.
